After the signature of an international act by the president or representative of the government, the document goes through a series of procedural steps and analyzes in the competent bodies of the State for its internalization in the Brazilian legal system.
At this stage, the preparation of the Interministerial Statement of Motives (EMI) begins, coordinated by the Ministry of Foreign Affairs (MRE), which is a document prepared within the scope of the Brazilian government with the objective of presenting and justifying a decision-making proposal involving different Ministries or areas of government.
Thus, the demand for documents that will support the preparation of the Explanatory Memorandum is forwarded by the MRE to the Ministries with attributions related to the theme of the international act in question. This analysis can involve different areas, such as economy, environment, health, culture, safety, among others.
Each Ministry carries out a detailed analysis of the content and implications of the act in relation to its attributions and sectoral interests, being issued merit and legal opinions.
Said documents - opinions, together with the EMI signed by the representatives of the Folders and the signed international act - are forwarded to the Civil House of the Presidency of the Republic, which analyzes the act and verifies that it is in accordance with Brazil's foreign policy.
After approval by the Civil House, it is forwarded to the National Congress for consideration, through a Presidential Message.
